PRIVACY POLICY

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

RevAir, LLC and its affiliates (“RevAir”, “we”, “our”, and “us”) respect your concerns about privacy and personal data protection and value our relationship with you.  This Privacy Policy (the “Policy”) applies solely to personal information collected through the RevAir website, online services, and web pages that post, specifically reference, and incorporate this Policy (all of the foregoing, collectively, the “Site”), whether accessed via computer, mobile device or another device (collectively, “Device”).

This Policy describes the types of personal information we collect through the Site and how that personal information may be used and/or with whom it may be shared.  This Policy also describes how you can reach us to update your personal information, access and control the use of the personal information, or get answers to questions you may have about our privacy practices at this site.

This Policy is incorporated into and made a part of the Terms of Use. Please read this Policy carefully, because by accessing, browsing, or otherwise using this Site you are acknowledging that you have read, understand, and agree to the terms of this Policy, and that you consent to the collection, use, and disclosure of your personal information as set forth in this Policy. If you do not agree with this Policy, do not access or otherwise use the Site. In addition, please review our Terms of Use, which governs your use of this Site.

WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products, and other updates.

Text marketing (if applicable): With your permission, we may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system.

Support communications (if applicable): By reaching out to our support team (email, text, live chat, phone call) your information is stored in our Customer Support software and a support ticket is created. This does not indicate consent or entry into our email marketing database.

SECTION 2 - CONSENT

CONSENT TO DATA COLLECTION AND PROCESSING 

You hereby agree with and consent to the collection and processing of your personal information as described in this Policy.

CONSENT TO INTERNATIONAL DATA TRANSFERS

Your personal information may be collected, processed and stored by RevAir or its service providers in the United States and other countries where our, or our service providers, servers reside.  Please be aware that the privacy protections and legal requirements, including the rights of authorities to access your personal information, in some of these countries may not be equivalent to those in your country. You hereby agree with and consent to the transfer of your personal data to the United States and other countries where RevAir and its service providers operate.

WITHDRAWAL OF CONSENT

You may have the right to withdraw your consent to RevAir’s collection and processing of your information, or to the transfer of your personal data to the United States and other countries. If you wish to request to withdraw your consent, please email RevAir at privacy@myrevair.com.

SECTION 3 – COLLECTION

PERSONAL INFORMATION YOU PROVIDE

When you visit this Site, you may choose to provide personal information that could reasonably be used to contact you or to identify you personally, including, but not limited to, your name, address, telephone number, and email address via the “Contact Support” page.

If you register for an account with the Site, we require that you provide certain personal information that could reasonably be used to contact you or to identify you personally, which may include, your name, email, address, and telephone.  Such information is necessary to provide services you may request from RevAir via the Site.

If you choose to make a payment on the Site, RevAir may ask you to provide your name, mailing address, telephone number, and email address, as well as certain financial information (e.g., credit card number) for the purposes of payment and processing of any order. Such information would be sent through a trusted third-party vendor for processing.  RevAir may collect the last four digits, expiration date, approval codes, reason code and date for denial, and card “nickname” for verification and to enhance the customer experience.

You may choose to receive certain communications from RevAir via your email address upon interaction with the Site.  From time to time RevAir may include surveys, information requests, or other features on the Site which ask you to provide personal information such as your name, telephone number, email address or mailing address. Any information you may provide will be used by RevAir to allow you to participate in the particular feature being offered. RevAir may also retain any information you provide in order to send you information about RevAir products and services that may be of interest to you. RevAir will provide you with the opportunity to opt-out of receiving such communications. We may use one or more service providers to administer these messages, but we do not share your email address with spammers or any other third parties without your permission.

Note that, even if you opt out of receiving promotional communications from RevAir, you may still receive administrative communications from us with respect to your use of the Site.

We may combine the personal information you submit directly through this Site with other personal information we have collected from you, whether on- or offline.  We may also combine it with information we receive about you from other sources, such as other companies, publicly available information sources, and other third parties.

SMS/MMS MOBILE MESSAGING MARKETING PROGRAM

We respect your privacy. We will only use the information you provide through the Program to transmit your mobile messages and respond to you if necessary. This includes but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.  WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY.

Nonetheless, we reserve the right at all times to disclose any information necessary to satisfy any law, regulation, or governmental request, avoid liability, or protect our rights or property. When you complete forms online or otherwise provide Us information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, at our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the program for an ulterior purpose, we may refuse you access to the program and pursue any appropriate legal remedies.

We use this information to send you text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us. Opt-in data and consent for text messaging will not be shared with any third parties except for messaging partners, for the purpose of enabling and operating our text messaging program.  

Our website uses cookies to keep track of items you put into your shopping cart, including when you have abandoned your checkout. This information is used to determine when to send cart reminder messages via SMS.

USER-GENERATED CONTENT

You are responsible for any data, information, images, messages, documents, and other content that you enter, submit, create, post, upload, transmit, or otherwise provide through or using the Site, including by providing feedback, participating in surveys, by uploading or providing photographs, or by submitting product reviews or testimonials (where such options are made available to you). “User-Generated Content” means all data, feedback, information, images, messages, documents, and other content that is entered or submitted to, posted on, uploaded to, transmitted, streamed, created, or displayed using, or otherwise provided via or using the Site by you or on your behalf.

All User-Generated Content is provided at your own risk. We cannot guarantee that User-Generated Content you provide will not be viewed by unauthorized persons. You understand that, even after removal, copies of User-Generated Content you have provided may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other Site users. We will make User-Generated Content available, including publicly available, to other Site users and to the public, as applicable and at its sole discretion, and will use and disclose User-Generated Content for the purpose for which it was provided as indicated at the point of collection. PASSIVE INFORMATION COLLECTION AND USE

As you navigate through and use this Site, certain information can be passively collected (that is, gathered without you actively providing the information), using various technologies.  We passively collect and use information in a variety of ways, including:

  • THROUGH YOUR BROWSER: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version, and Internet browser type and version.  We may collect similar information, such as your Device type and identifier if you access this Site through a mobile device. 

  • COOKIES: Cookies are pieces of information stored directly on the computer you are using.  Cookies allow us to collect information such as browser type, time spent on this Site, pages visited, and language preferences.  We and our service providers use the information for security purposes, to facilitate navigation, and to display information more effectively.  In addition, we use cookies to gather statistical information about Site usage in order to continually improve its design and functionality, understand how individuals use it, and assist us with resolving questions regarding it.

    You can choose to accept or decline cookies.  Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer.  If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) to disable existing cookies; or (iii) to set your browser to automatically reject any cookies.  If you set your browser to reject cookies, part of the Site may not work for you.

  • Pixel tags, web beacons, clear GIFs, or other similar technologies: These may be used in connection with some Site pages too, among other things, track the actions of Site users and compile statistics about Site usage and response rates.

  • IP Address: Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider.  An IP Address is identified and logged automatically in our server log files whenever a user visits this Site, along with the time of the visit and the page(s) that were visited.  Collecting IP Addresses is standard practice on the Internet and is done automatically by many websites.  We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering this Site.

  • Device Information: We may collect information about your Device, such as a unique device identifier.

  • Do Not Track Requests: Your selection of the “Do Not Track” option provided by your browser may not have any effect on our collection of cookie information for analytic and internal purposes.  The only way to completely opt out of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or Device to delete and disable cookies and other tracking/recording tools.  Please note, depending on your type of Device or browser, it may not be possible to delete or disable all tracking mechanisms on your Device. However, residents of certain U.S. states may opt-out by broadcasting an Opt-Out Preference Signal under applicable law, including the Global Privacy Control (GPC), depending on which browsers and/or browser extensions you use that may support such a signal. We permit third-party advertising partners to use the foregoing tracking technologies to collect information about your browsing activities over time and across different websites when you use the Site.  For example, we use advertising services provided by third-party ad partners, such as Google, to market our service to you on other websites and online services.  Through a process called “retargeting,” each service places a cookie on your browser when you visit the Site so that they can identify you and serve you ads on other sites around the web based on your browsing activity. 

Through Google Ads, Google uses your Internet searches, cookies, and similar identifiers (e.g., pixel tags) to collect information about your visits to the Site and your interaction with our products and services to generate targeted advertisements to you on other websites that you visit across the Internet. We may also enable and implement Google Analytics Advertising Features on the Site. To opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use this information, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Site.

To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, please visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Please remember that changing your settings with individual web browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time. Your device may also include a feature (“Limit Ad Tracking” on iOS or “Opt Out of Interest-Based Ads” on Android) that allows you to opt out of having certain information collected through apps used for behavioral advertising purposes.

To avoid use of this information for advertising by these third-party ad partners, you can change your browser settings to reject cookies or to notify you when cookies are set, and you could select the Do Not Track option on your browser, though we have no control over and cannot confirm whether these third-party ad partners honor the Do Not Track browser signal.  Additionally, many advertising companies are members of the NAI or DAA and/or provide opt-outs on those industry pages at www.networkadvertising.org/choices or www.aboutads.info/choices.

We utilize Google Analytics on the Site. Google Analytics is a website analysis service provided by Google, Inc. (“Google”). Google utilizes the data collected to track and examine the use of this Site, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network.

We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website. Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt-out by visiting the Network Advertising Initiative Opt-Out page or by using the Google Analytics Opt-Out Browser Add-on.

INTEGRATED ACCOUNTS AND SOCIAL MEDIA INFORMATION

We may implement applications or "widgets" from third-party providers (e.g., Facebook, Twitter, Instagram, LinkedIn, etc.) that allow interaction, integration, or content sharing with third-party services.  These widgets or applications may be visible on a page you visit on our Site or may require log-in through the third-party provider’s service.  

The third-party providing the widget or integration may offer controls for you to manage your interactions.  Any interaction with a third-party widget or application typically allows the third party to collect some information about you (whether through cookies, registration information, or otherwise).  These third parties may even track you when you do not interact with the widget. 

If you have engaged with any of these third-party service providers, their respective privacy policies will govern their tracking and collection of information.  You should review these third-party policies to understand these practices.

SECTION 4 - DISCLOSURE

We may use and disclose personal information from or about you:

  • to respond to your inquiries and fulfill your requests, such as to send you documents you request or e-mail;
  • to send you important information regarding our relationship with you or regarding this Site, changes to our terms, conditions, and policies and/or other administrative information;
  • for our business purposes, such as marketing new products and services, data analysis, audits, developing new products or services, operating or enhancing our Site, improving our products and services, identifying Site usage trends, providing products and services, maintaining customer relationships, improving the quality, safety, and security of our products and services, administering your account(s), troubleshooting, supporting electronic signature, customizing and improving communication content, evaluating product performance, providing customer support and product support, and determining the effectiveness of our Site;

  • to de-identify and/or aggregate personal information and use and disclose that aggregate and/or de-identified data for our business purposes, in each case to the extent permitted by applicable law; and
  • when we otherwise have your consent.

In addition, we may use and disclose personal information collected through this Site as we believe to be necessary or appropriate: (a) as permitted by applicable law, including laws outside your country of residence; (b) to comply with any legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our Terms of Use; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. 

We also use and disclose information that is not in personally identifiable form (such as anonymized, masked or de-identified information) for any purpose. If we combine information that is not in personally identifiable form with information that is (such as combining your name with your geographical location), we will treat the combined information as personal information as long as it is combined.

USE OF INFORMATION FOR MARKETING PURPOSES

We may share data with select third parties, such as our advertisers, for purposes of serving you with customized promotions. If you would like to learn more about the sharing of data for purposes of providing customized advertisements or promotions, please visit http://www.aboutads.info/consumers/. We do not sell any of your personal information, including your name, mailing address, or email address, to any companies.

RevAir and our affiliates may send you regular promotional communications about our products, services, events, and promotions.  Such promotional materials may use the “RevAir” brand and may be sent to you via different channels, such as; email, phone, SMS text messages, postal mailings, and third-party social networks. In order to provide you with the best, personalized experience; sometimes these communications may be tailored to your preferences (for example, as you indicate these to us, as we may have inferred from your Site visits, or based on the links you click in our emails). 

When required by applicable law, we will obtain your consent before starting these activities.  In addition, you may withdraw your consent (opt-out) at any time. In particular, you can opt-out from receiving marketing-related emails by following the unsubscribe instructions provided in each email.  You can also contact us using the contact details provided below to opt-out from receiving marketing-related communications.

Please note that even if you opt-out from receiving marketing communications, you might still receive administrative communications from us, such as technical updates of our products, order confirmations, notifications about your account activities, and other important notices.

SECTION 5 - SHOPIFY

Our store is hosted on Shopify, Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

PAYMENT

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 6 - THIRD-PARTY SERVICES

In general, the third-party providers we use will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions. 

For these providers we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

LINKS

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

EMBEDDED CONTENT

The Site may incorporate content, including feeds, scripts embedded in the Site’s code, and visible content (e.g., videos) provided by third parties. In some cases, those third parties collect data about how you interact with their content. Our Site may use YouTube to make content in video format available to you. By accessing a part of the Site where videos are available, watching an embedded video, or otherwise interacting with any content made available through YouTube, you signify your agreement with YouTube’s terms and conditions. YouTube collects and otherwise has access to usage data (e.g., what videos you accessed and watched) through videos embedded in the Site, as further described in YouTube’s Privacy Notice. YouTube adheres to Google's privacy policies and principles, part of which allows you to control certain privacy settings and which data are collected. SECTION 7 - SECURITY

Personal information you provide to us should be relevant to the purposes for which it is to be used and, to the extent necessary for those purposes, should be accurate, complete, and up to date. To protect your personal information, we take reasonable precautions and follow industry best practices designed to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed. However, we do not and cannot guarantee that unauthorized access, unauthorized disclosure, loss, theft, misuse, and alteration of information will not occur. We do not publish all of our security measures online because this may reduce the effectiveness of our security measures. The storage and communication of information can never be completely secure.

SECTION 8 - COOKIES AND TRACKING TECHNOLOGIES

The Site automatically use cookies to track your use of the Site in order to facilitate and enhance the user experience on the Site and for other purposes as described below. Cookies are small pieces of information that are stored on your device’s hard drive by your web browser. We use cookies to learn and track how you access and use the Site, including when and how users visit the Site and how popular particular Service pages are and aren’t. We also use cookies to recognize Site users, to help display information on the Site, and to improve your enjoyment and the usefulness of the Site, for example, by remembering and displaying certain information.

A cookie can either be a “session” cookie or a “persistent” cookie. Session cookies exist only for so long as you are visiting the applicable website. Web beacons are tiny graphics with unique identifiers that function similarly to how cookies function, but, in contrast to cookies, web beacons are embedded invisibly on websites. We do not knowingly collect information that is considered “sensitive” under applicable law.

RIGHTS

Applicable laws in your jurisdiction may grant you certain rights—subject to all applicable limitations, exemptions, or exceptions—regarding our collection and use of your personal information. Subject to foregoing, in addition to all application limitations, exemptions, or exceptions—regarding our collection and use of your personal information—these rights may include, to the extent applicable:

  • The right to request access to any of your personal information that we hold.   • The right to receive all such personal information about you from RevAir in a structured, commonly used, and machine-readable format, and also to require us to transmit it to another entity where this is technically feasible;

  • The right to opt-out of targeted advertising and the sharing of personal information that is shared for cross-contextual behavioral advertising purposes;
  • The right to opt-out of the sale of your personal information;
  • The right to not be discriminated against due to your exercise of your rights under applicable law. We do not discriminate against users for exercising the rights granted to them under applicable law and that are applicable to our processing of your personal information.

The above rights are only exercisable by you where the applicable law grants you the right being exerted and where no exception or exemption under applicable law applies. You may also have a registered agent (if and only as permitted under applicable law) that you authorize to act on your behalf. If you have a registered agent act on your behalf, we have the right to authenticate such agent’s authority to act. To exercise the rights described herein (only to the extent applicable), you may submit a verifiable request to us by through the methods set forth under the “Exercise Your Rights” section below.

SELLING AND SHARING

We do not sell your personal information as the concept of “selling” is traditionally understood as being the exchange of something for money. However, we sell your personal information to, and share your personal information with, third parties for the purpose of cross-contextual behavioral advertising purposes (e.g., targeted advertising and remarketing). Applicable U.S. state data protection laws hold such disclosures and sharing to be considered “selling” or “sharing”. Therefore, you have the right to opt out of such selling and sharing. In the preceding 12 months, we have sold or shared the following categories of personal information with the following categories of third parties and for the following purposes:

You have the right to opt-out of the selling or sharing of your personal information as described herein. You may exercise this right to opt-out by contacting us through the methods set forth below under the “Exercise Your Rights” section of the Policy or by clicking the “DO NOT SELL OR SHARE MY PERSONAL INFORMATION”.

We do not knowingly sell or share for cross-contextual behavioral advertising purposes, the personal information of anyone under the age of 16 years old. See the “Children” section of this Policy below for more information.

SECTION 10 - ADDITIONAL INFORMATION FOR CANADIAN RESIDENTS

The following section of this Policy only applies to Canadian residents. Under Canadian laws and regulations, you may have certain rights in regard to our collection of personal information (subject to all exemptions and exceptions, as applicable). These rights include:

  • The right to request access to your personal information;
  • The right to request corrections to your personal information; and
  • The right to lodge a complaint with the Office of the Privacy

Commissioner of Canada and/or the applicable Canadian provincial regulatory body if you consider that the collection and use of your personal information violates this Privacy Policy or applicable law.
The above rights are only exercisable by you where applicable law in the jurisdiction in which you reside actually grants you the right being exerted.

SECTION 11 - EXERCISE YOUR RIGHTS

If this Policy expressly stated above that you have certain rights or applicable law grants you certain rights as it relates to this Policy and your personal information, you may submit a verifiable request to us by 

Only you or a registered agent (if and only as permitted under applicable law) that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. If you have a registered agent act on your behalf, we have the right to authenticate such agent’s authority to act. Without limiting the foregoing, the verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. 

We will respond to your request within the applicable timeframe required under applicable law. If we deny your request, you can appeal such denial by emailing us at privacy@myrevair.com

SECTION 12 - CHILDREN

The Site is not directed at children under 16 years of age. We do not knowingly collect or use information from children under 16 through the Site. If a parent or legal guardian becomes aware that a child under the age of 16 has provided information to us through the Site, the parent or legal guardian should contact us using the information below under “Contact Us” and we will use commercially reasonable efforts to delete that information.

SECTION 13 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
